Santa Clarita DUI Crackdown

There are a high number of DUI arrests throughout the Santa Clarita Valley.  Both the Los Angeles County Sheriff's Dept. and the California Highway Patrol devote a good number of resources to combat DUI drivers, as evidenced by the high number of DUI arrests this past Labor Day weekend.  Berglund Law Office, P.C. is a law firm that specializes in defending persons arrested for DUI.  Call our traffic law firm at (877) 667-1205 or submit the CONTACT form if you were arrested for DUI in the Santa Clarita Valley.  DUI Attorney Robert D. Berglund works tirelessly in representation of his clients to ensure that they are treated fairly under the law and receive the best possible outcome in their DUI cases. If you were arrested for DUI you will likely have two separate actions against you: criminal charges and a DMV administrative action.

Criminal Charges Filed

DUI is a criminal offense, not to be mistaken with a traffic violation such as running a stop sign or speeding.  If you are arrested for DUI in Santa Clarita, it is likely that criminal charges will soon be filed against you.  DUI's are usually misdemeanors but can be felonies in certain situations, e.g. a 4th DUI within a 10 year period is filed as a felony.  Whether a misdemeanor or felony, a DUI conviction can have a devastating impact on a person's life, adversely affecting employment, finances, child custody agreements, and freedom.

Santa Clarita DUI Cases

Misdemeanor DUI cases will be filed at the Santa Clarita Courthouse.  The case will be in either Dept.1 - Commissioner Martin Gladstein, Dept. 2 - Judge Gary Micon, or Dept. 3 - Judge Maria Cavalluzzi.  Felony DUI cases will be filed at the San Fernando Courthouse.  If you have been arrested for DUI in Santa Clarita do not go to Court alone and represent yourself.  Do not assume that you must plea guilty to DUI and have no other options.  CONTACT our office today for a free and confidential consultation with an experienced Santa Clarita DUI lawyer.

10 Days to Request Santa Clarita DMV Hearing

If you were arrested on suspicion of DUI involving alcohol, the Los Angeles County Sheriff's Department deputies or California Highway Patrol officers likely confiscated your driver's license and issued a pink "temporary" license that is good for 30 days.  However, you only have 10 days from the arrest date to request a Department of Motor Vehicles (DMV) Administrative Per Se (APS) hearing.  Santa Clarita APS hearings are held at the Van Nuys Driver Safety Office.

Automatic Driver's License Suspension

If you fail to request an APS hearing within 10 days, your driver's license will automatically be suspended 30 days from the arrest date (upon expiration of the temporary license).  How long the license remains suspended will depend on whether or not you have prior DUI offenses and how many and/or whether you refused to submit to a breath or blood test following your arrest.  An experienced Santa Clarita DUI lawyer should be contacted as soon as possible following a DUI arrest to ensure that your driving privilege is protected.

DUI Enforcement in Santa Clarita

The Los Angeles County Sheriff's Department provides police protection for Santa Clarita, with the Santa Clarita Station located on Magic Mountain Parkway.  The California Highway Patrol patrols on and around the 5 and 14 Freeways through the Santa Clarita Valley.  CHP will also conduct its own checkpoints, such as this one conducted by its Newhall Area Office that took place in the Santa Clarita Valley this past June.  DUI saturation patrols and DUI checkpoints are common throughout the Santa Clarita Valley.  A major benefit of DUI checkpoints are the deterrent effects it has on those who might drive drunk or drugged impaired, bringing about more awareness and encouraging everyone to use sober designated drivers.

Zero Tolerance

Law enforcement officers in the Santa Clarita Valley have zero tolerance for DUI drivers.  DUI arrest reports from Santa Clarita are forwarded to the Los Angeles County District Attorney's Office for criminal prosecution.  DUI's are taken very seriously by Santa Clarita law enforcement.  The majority of the cases on the Santa Clarita Courthouse criminal calendar are DUI's.  If you have been arrested for DUI in Santa Clarita, Canyon Country, Newhall, Saugus, or Valencia, CONTACT our office today for a consultation with DUI Lawyer Robert D.
