Two Separate Actions Against You

If you have been arrested for a DUI involving alcohol and you provided a chemical test of .08 or higher blood alcohol content, the officers that arrested you likely seized your California driver's license.  The officers then mailed it to the California Department of Motor Vehicles (DMV), along with a DS367 form which provides the DMV with the DUI information that they need in order to suspend your license.  There will be a DMV action against you and criminal charges filed in court.  One or both can result in a driver's license suspension.

10 Days to Request DMV Hearing 

If you were arrested on suspicion of DUI involving alcohol in Northridge, the LAPD or other law enforcement officers likely confiscated your driver's license and issued a pink "temporary" license that is good for 30 days.  However, you only have 10 days from the arrest date to request a DMV Administrative Per Se (APS) hearing from the DMV Driver Safety Office.  If you fail to request an APS hearing, your driver's license will automatically be suspended upon expiration of the temporary license.
