Berglund Law Office, P.C. is a law firm that specializes in defending persons arrested for driving under the influence and other traffic violations.  DUI Attorney Robert D. Berglund vigorously represents his clients to ensure that they are treated fairly under the law and receive the best possible outcome in their cases.  Call our office today at (877) 667-1205 or submit our online CONTACT form if you were arrested for DUI in Los Angeles.  Mr. Berglund will personally return your phone call or respond to your email message to discuss your Los Angeles DUI arrest.  If you were arrested for DUI involving alcohol, and your B.A.C. test was .08 percent or higher, there will be two different actions taken against you: criminal charges and a DMV case.

DUI Criminal Charges Filed

If you are arrested for DUI in Los Angeles, a criminal complaint will be filed against you unless the prosecutor declines to file the case due to insufficient evidence.  A DUI conviction can have a devastating impact on a person's life, adversely affecting employment, finances, reputation, child custody agreements, and freedom.  DUI criminal cases can be filed at any number of Los Angeles County courthouses, depending on the location of the arrest.  Multiple DUI convictions can result in substantial jail time and, if you are not a United States citizen or legal resident, serious adverse immigration consequences.  Do not go to Court alone and represent yourself.  Do not assume that you must plea guilty to DUI and have no other options.  CONTACT our office today if DUI criminal charges have been filed against you.

10 Days to Request DMV Hearing

In addition to a possible criminal conviction, a DUI can have serious driver's license consequences.  If you were arrested on suspicion of DUI involving alcohol, the LAPD or other law enforcement officers likely confiscated your driver's license and issued a pink "temporary" license that is good for 30 days.  However, you only have 10 days from the arrest date to request a Department of Motor Vehicles (DMV) Administrative Per Se (APS) hearing from the DMV Driver Safety Office.  If you fail to request an APS hearing, your driver's license will automatically be suspended upon expiration of the temporary license.

DUI Driver's License Suspension

How long the license remains suspended will depend on whether or not you have prior DUI offenses and/or whether you refused a post-arrest chemical test (California's implied consent law requires that you submit to a breath or blood test following a DUI arrest).  You should CONTACT an experienced Los Angeles DUI Lawyer as soon as possible following a DUI arrest to ensure that your driving privilege is protected.  If our office is hired within 10 days of the arrest date, we will request a "stay" of the license suspension pending the outcome of the hearing.  If we are not hired within 10 days, and the client has not requested a hearing date on their own, we will carefully reviewed what occurred following the arrest in order to determine if there is a basis to make a "late hearing" request.  CONTACT our office immediately if your DUI arrest was more than 10 days ago and you have not called DMV to request an APS hearing.

LAPD DUI Enforcement in Los Angeles

Los Angeles Police Department and other law enforcement officers in LA are trained to look for drivers who may be under the influence of alcohol or drugs.  Officers look for drivers to commit moving violations that will give them a lawful reason to pull the driver over.  LAPD also actively operates DUI checkpoints throughout Los Angeles.  If officers observe objective symptoms of impairment, such as bloodshot/watery eyes, odor of alcohol, and slurred speech, a DUI investigation will be performed.  If it is determined that the driver is DUI he or she will be arrested.  Misdemeanor DUI arrest reports within the city limits of LA are forwarded to the Los Angeles City Attorney's Office for criminal prosecution.  Felony DUI arrest reports are forwarded to the Los Angeles County District Attorney's Office.  If you need a Los Angeles DUI Lawyer to defend you against DUI charges, CONTACT our office today.

Types of DUI Cases

You can be arrested for driving under the influence of alcohol, marijuana, illegal drugs, and prescription drugs.  If the officers believe that your ability to drive has been impaired, they will conduct a DUI investigation.  If you were observed driving recklessly, got into an accident, fail to perform well on the field sobriety tests, or show other signs of impairment, you will be placed under arrest for DUI and be taken to jail.

DUI Defenses

The possible defenses to the charges vary depending on the type of case and the specific circumstances.  In addition to listening to your recollection of the events of the incident, a good DUI Lawyer will thoroughly review the police report, review any and all available audio or video of the investigation and arrest, and consult with an expert to review breath and/or blood analysis records.  A customized "game plan" to defend you will then be developed specific to the facts and circumstances of your case.  The penalties are the same for DUI's involving drugs as they are for DUI's involving alcohol.

You can get a DUI anywhere in Los Angeles.  The California Highway Patrol is on the lookout for drunk drivers on the many LA freeways.  The Los Angeles Police Department patrols the city streets for DUI drivers, especially those sections of the city with a vibrant nightclub and bar scene, such as Hollywood and Downtown.  DUI patrols and DUI checkpoints are common throughout Los Angeles.
