NY Times Investigation Finds Breath Testing Equipment Frequently Unreliable

The importance of properly maintained and calibrated breath testing equipment is well known to DUI attorneys.  Our DUI ALCOHOL page discusses some of the issues that can lead to inaccurate readings of blood alcohol results, which are critical evidence in the prosecution of DUI cases involving alcohol.  The New York Times recently published the results of a very thorough investigation into the problems associated with breath test results, including some fatal flaws with the machines themselves.  The authors also found many problems caused by human error of law enforcement officers and laboratory officials.  The authors correctly find that the breath tests performed on a machine that has not been calibrated can read up to 40 percent too high.  Inaccurate breath test results can make the difference between a DUI conviction or not.  You can read the full article here.
